The state’s main concern is protecting individual’s property rights. The people that would benefit are developers. They would be allowed to mow down trees without any thought to design around them, and then just plant trees in tight spaces or pay a fine. It has been my personal experience that projects where the owners ultimately occupy the space receive good consideration for working around the trees. Investment projects, where the owners do not occupy the space, tend to want to clear cut the trees.

Keep in mind it’s proposing $100/inch of girth. Most ordinances base mitigation on diameter. $100/girth-inch = $32/diameter-inch.
